仿冒品,指未经商标权利人的授权而使用该商标进行仿造或复制的产品。
微信作为即时通讯工具,致力于保护互联网知识产权。 微信用户如发现微信个人帐号存在发布仿冒品信息,损害微信用户或商标权利人(即品牌方)的合法权益,可通过微信手机客户端向已接入微信品牌维权平台的品牌方提交线索,品牌方对线索进行鉴定并通知微信,微信对相关帐号进行处理。
一、售假投诉处理流程
- 用户向品牌方提交仿冒品举报线索
- 品牌方对线索进行鉴定,并通知微信
- 微信处理相关帐号并通知微信用户和品牌方
注意事项:仿冒品投诉鉴定需要用户提供与被投诉帐号的微信聊天截图等详细证据材料
二、微信品牌维权平台接入
如需接入微信品牌维权平台,品牌方可按照《接入指引》提供相关材料申请接入。
三、投诉方法

通过“详细资料”页发起:打开微信客户端,进入投诉对象 “详细资料”页 > 轻触右上角“...” > 选择“投诉” > 选择“发布仿冒品信息”;

通过“朋友圈”发起:打开微信客户端,进入朋友圈>长按被投诉人头像>选择“投诉” >选择“发布仿冒品信息”。
四、处理结果反馈
品牌方的侵权投诉通知送达微信团队并经核实后:
- 对被投诉的内容,将会依据《腾讯微信软件许可及服务协议》 《微信个人帐号使用规范》和相关法律法规进行相应处理;
- 对处理结果,将通过“微信团队”公众号对投诉人进行反馈;同时也会通过“微信团队”公众号或微信客户端的系统提示告知被投诉人。
五、申诉
如果被投诉人对品牌维权投诉的处理结果有异议,可按照《申诉指引》,提供相关材料发起申诉。
Counterfeit product is an imitation or reproduction product, often of inferior quality, made under another's brand name without the brand owner's authorization.
Weixin, as an instant messaging tool, is dedicated to protecting intellectual property rights on the Internet.
Any Weixin user who discovers any suspicious information of counterfeit products which is posted by other user, may submit clues to Weixin Brand Protection Platform (hereinafter referred to as “BPP”) through the Weixin APP. Those clues will be received and identified by the brand owner, and the result of identification will be sent to Weixin. Then Weixin will take actions to the alleged infringing account accordingly.
I. Handling Process for Reportings on Counterfeit Products
1. The user submits the clues of counterfeit products to the brand owner;
2. The brand owner identifies the clues and notifies Weixin (Tencent);
3. Weixin (Tencent) takes actions to the relevant account and notifies the relevant user and the brand owner.
Note: Identification of complaints on counterfeit products requires users to provide detailed evidentiary materials of the complained accounts including Weixin chat screenshots.
II. Access to the Weixin Brand Protection Platform
If any brand owner needs to access to the BPP, it may submit application in accordance with the Access Guidelines.
III. Reporting Methods
Method 1: Initiate a report through the Profile page: Open the mobile Weixin App and enter into the Profile page of the reported account > Press "..." in the upper right corner > select "Report"> select "Post Counterfeit Products Information";
Method 2: Initiate a complaint through "Moments": Open the mobile Weixin App, press Discover, enter into Moments> long press the profile photo of the reported user > select "Report"> select "Post Counterfeit Products Information".
IV. Feedback of Processing Results
After receiving and verifying the identification result from the brand owner, Weixin (Tencent), will:
1. Deal with the complained content according to the Agreement on Software License and Service of Tencent Weixin, Weixin Personal Account Use Policy and relevant laws and regulations;
2. Feedback the processing result to the reporter via “微信团队” the official account of the Weixin (Tencent), at the same time, notify the reported user through the official account or Weixin system.
V. Appeal
If the reported user disagrees with the processing result of the infringement report, it may provide relevant materials and make an appeal in accordance with the Guidelines on Appeal.
