鉴于品牌维权平台涉及第三方利益,为保证处理流程公平、公正,保护权利人的合法权益,根据相关法律法规的规定,腾讯特制定本申诉指引。如果你对品牌方的投诉存在异议,请根据本指引向我们提出申诉。
一、申诉流程
1、通知腾讯
若申诉人对品牌方的投诉存在异议,请在收到帐号处置通知的五个工作日内,按要求提交申诉材料,通知腾讯。

2)通知腾讯的方式:将书面通知书及其他相关证明材料的纸质版本扫描件(须签字),发送至邮箱 notice_wxcou@tencent.com。
2、申诉材料说明
1)申诉人主体信息和相关材料
① 如果你是单位,请提供营业执照;
② 你是个人的,请提供个人身份信息证明,包括但不限于身份证、护照、港澳通行证等;
③ 如果申诉人委托他人代为申诉的,除①②所述主体证明材料外,还需提供
a. 加盖申诉人公章(单位)或签字(个人)的授权委托书;
b. 代理人为单位时,需提供代理人的营业执照;
c. 代理人为个人时,提供代理人的个人身份信息证明,包括但不限于身份证、护照、港澳通行证等。
2)初步证明材料
初步证明材料包括但不限于:
① 相关品牌方的授权证明;;
② 权威机构的鉴定结果证明或证明材料(如海关报关单、入境货物检验检疫证明、订货合同、供货渠道证明书、增值税专用发票、普通发或完税凭证等证明物品来源渠道正规的资料)。
如不提供初步证明材料,则申诉难以成立。
3、注意事项
1)本指引中的申诉人,指被品牌方投诉为通过微信帐号发布仿冒品信息的个人,代理人是指经原始申诉人合法授权的受托人,包括自然人、法人或其他组织等。
2)为了确保申诉人提供相关材料的真实性和有效性,申诉人的书面通知书及相关证明材料,一般应提供原件,不能提供原件的,应提供复印件(在复印件上应有权利人的签章),若材料涉外的,应按照法律的规定进行公证转递,并同时提供相应的公证转递材料。
3)本指引中申诉人的书面通知书,均应包括通知书本身及相关的主体资格材料、相关证明等材料。
二、腾讯反馈
腾讯作为中立的平台服务者,收到申诉人符合本指引要求的通知书后,会按照相关法律法规的规定进行处理,并在符合法律规定要求的情形下将申诉人的通知书转送给品牌方。
若品牌方不认可申诉人的申诉,腾讯会将品牌方提供的相关证明材料转送给申诉人,若申诉人对于品牌方的意见及其提供的相关材料有异议的,腾讯建议申诉人另行通过行政投诉、诉讼等方式直接和品牌方解决相关问题。如果申诉人有新的并可充分推翻品牌方意见的证明材料的,也可向腾讯提供。
The Weixin Brand Protection Platform (hereinafter referred to as “BPP”) is dedicated to protecting the legitimate rights and interests of users and purifying the platform environment. As a neutral platform service provider, Weixin (Tencent) will cooperate with brand owners to fight against counterfeit products.
In view of the interests of third parties involved in BPP, Weixin (Tencent) formulates these Guidelines on Appeal in accordance with relevant laws and regulations to ensure that the handling process is fair and equitable and to protect the legitimate rights and interests of right owners. If you have any objection to the brand owner's complaint, you may appeal to us according to the Guidelines.
I. Appeal Process
1. Notify Weixin (Tencent)
If the appellant has any objection to the brand owner’s complaint, it should submit appeal materials as required and notify Weixin (Tencent) within five working days after receiving the account processing notice.

2) Way to notice Weixin (Tencent): send the scanning copies of written notice and other relevant paper evidentiary materials (subject to appellant's signature) to the following email notice_wxcou@tencent.com.
2. Requirements of Appeal Materials
1) Information and Related Materials of the Appellant
① If you are a legal entity, please provide a business license;
② If you are an individual, please provide proof of personally identifiable information, including but not limited to ID card, passport and/or Hong Kong/ Macao pass;
③ If the appellant entrusts and authorizes third party to file an appeal, it should provide the following materials in addition to the proof materials of the appellant mentioned in ① and ②
a. A power of attorney stamped with the official seal (legal entity) of the appellant or signed (individual) by the appellant;
b. If the authorized party is a legal entity, the business license of the authorized party is required;
c. If the authorized party is an individual, proof of personally identifiable information of the authorized party is required, including but not limited to ID card, passport and/or Hong Kong/ Macao pass.
2) Preliminary Evidentiary Materials
Preliminary evidentiary materials include but are not limited to:
① Proof of authorization of relevant brand owner;
② Any identification result or evidentiary materials issued by authoritative organization (such as customs declarations, inspection and quarantine certificates of imported goods, ordering contracts, supply channels certificate, special value-added tax invoices, ordinary invoices, tax payment certificates or other materials to prove the proper sources and channels of the goods).
If you do not provide preliminary evidentiary materials, the appeal may not be accepted.
3. Notes
1) The appellant in the Guidelines refers to a person who is complained by a brand owner for posting counterfeit products information via Weixin.
2) In order to ensure the authenticity and validity of the materials provided by the appellant, the original copy of written notice and relevant evidentiary materials shall be provided in principle. If the originals are not available, the photocopies (with signature and stamp of the right holder) should be provided. Any foreign-related material shall be notarized in accordance with the relevant laws and regulations. At the same time, the appellant shall provide the corresponding notarized materials.
II. Feedback
As a neutral platform service provider, Weixin (Tencent), upon receiving the notice conforming to the Guidelines from the appellant, will process the appeal in accordance with relevant laws and regulations and forward the appellant’s notice to the brand owner in circumstances complying with the requirements of the laws and regulations.
If the brand owner objects the appeal of the appellant, Weixin (Tencent) will forward relevant evidentiary materials provided by the brand owner to the appellant. If the appellant disagrees with the opinions and relevant materials provided by the brand owner, Weixin (Tencent) recommends the appellant to solve the problem directly with the brand owner through administrative relief, litigation and/or other ways. If the appellant has any new evidentiary material that could fully reverse the views of the brand owner, it may also provide them to Weixin (Tencent).
